These Terms & Conditions govern access to the ENLUME website, the use of our services and all purchases, sample orders, wholesale orders, bulk orders, OEM/ODM projects, private label projects and other customized business transactions placed with ENLUME.
ENLUME is operated by HK ENLUME INTERNATIONAL FASHION TRADING LIMITED. In these Terms & Conditions, “ENLUME,” “we,” “us” and “our” refer to HK ENLUME INTERNATIONAL FASHION TRADING LIMITED, while “buyer,” “customer,” “you” and “your” refer to the person or business using the website, requesting a quotation or placing an order.
By using this website, submitting an inquiry, approving a quotation, making payment or placing an order, you acknowledge that you have read and agreed to these Terms & Conditions and the applicable order documents.
Business-to-Business Use
ENLUME primarily supplies jewelry products and related services for business purposes, including resale, sourcing, product evaluation, wholesale purchasing, distribution, OEM/ODM development and private label projects.
By placing a business order, you confirm that:
- You are acting for legitimate commercial or professional purposes.
- You have the authority to act for the company or organization identified in the order or quotation.
- The information provided to ENLUME is complete and accurate.
- You are legally able to enter into the relevant transaction.
If mandatory consumer rights apply to a particular transaction, nothing in these Terms & Conditions excludes or limits rights that cannot lawfully be excluded or limited.
Website Information and Use
We aim to keep the website, product information, pricing and service information reasonably accurate and up to date. However, information may be corrected, updated, replaced or withdrawn without prior notice.
You must not use the website:
- For unlawful, fraudulent or misleading activities.
- To interfere with the security, availability or operation of the website.
- To introduce malicious code, automated scraping tools or unauthorized data collection systems.
- To impersonate another person, company or organization.
- To infringe intellectual property, privacy or other legal rights.
We may restrict or suspend access where we reasonably believe the website, account, ordering process or communication channels are being misused.
Product Information
Product descriptions, dimensions, weights, materials, colors, finishes, plating details, gemstones, components and packaging information are provided for general identification and purchasing reference.
Unless expressly confirmed in writing:
- Measurements and weights are approximate and may vary within normal production tolerances.
- Product colors may appear different because of photography, lighting, screen settings or display conditions.
- Natural pearls, natural stones, handmade elements, enamel, glass, resin and plated finishes may contain normal variations in color, shape, texture, pattern or surface appearance.
- Product availability, materials, components and finishes may vary by style.
- Images are illustrative and may not show every detail, scale or production variation.
Minor variations that fall within an approved sample, confirmed specification, agreed tolerance or the normal characteristics of the material and production process are not normally considered defects.
Order Types
Online samples and small wholesale orders
Available ready-stock products may be ordered through the website for sample evaluation and small wholesale purchasing, subject to the online minimum order quantity, warehouse availability and checkout requirements.
Bulk ready-stock orders
For larger ready-stock or mixed-product quantities, buyers may contact ENLUME before payment to request a bulk quotation. Pricing depends on the selected products, quantities, inventory availability and order combination.
OEM/ODM and private label projects
New designs, material changes, plating changes, color customization, logo application, custom packaging, private label services and other customized projects are handled through a separate project review, quotation and approval process.
Minimum Order Quantities
The minimum quantity for eligible online sample and small wholesale orders is currently 5 pieces for the entire cart, not 5 pieces per style. Different available styles and colors may be combined, and each available SKU may start from 1 piece, provided that the total cart quantity reaches the required minimum.
The online 5-piece minimum does not apply to OEM/ODM, logo, custom packaging, private label or other customized projects.
Customization minimum order quantities are confirmed separately according to the product structure, materials, components, finish, tooling, production method and packaging requirements.
Unless otherwise confirmed in writing:
- Newly developed designs and major product modifications generally start from 200 pieces per style.
- Changes involving materials, stones, pearls, components, dimensions or product structure generally start from 200 pieces per style.
- Color-only or plating-finish changes generally start from 120 pieces per style.
- Logo application and custom packaging projects generally start from 120 pieces per style.
These quantities are general starting points only. Final feasibility and minimum order quantities must be confirmed after project review.
Quotations
A quotation is based on the information available at the time it is prepared, including product specifications, quantities, materials, components, finish, packaging, destination, shipping requirements and expected schedule.
Unless stated otherwise, a quotation:
- Is valid only for the period stated in the quotation.
- Applies only to the products, quantities and specifications listed.
- May be revised if product requirements, quantities, materials, packaging, delivery details or other project conditions change.
- Does not guarantee inventory, production capacity, material availability or delivery dates until the order has been accepted.
Verbal discussions, informal estimates and preliminary price indications are not final commitments unless confirmed by ENLUME in writing.
Order Submission and Acceptance
Submitting an online order, completing checkout, making payment or receiving an automated acknowledgment does not by itself guarantee final order acceptance.
All orders remain subject to review, including:
- Product and warehouse availability.
- Minimum order requirements.
- Pricing and payment verification.
- Shipping availability and destination restrictions.
- Customization feasibility and production capacity.
- Compliance, fraud-prevention and risk checks.
An order is accepted when ENLUME confirms acceptance in writing, confirms fulfillment or dispatches the relevant products.
If an item is unavailable or an order cannot be accepted as submitted, we may contact you to discuss an estimated lead time, replacement product, adjusted quantity, partial shipment, revised quotation, refund of the affected item or another suitable solution.
Prices and Currency
Prices are displayed in the currency selected or shown on the website. Currency conversion, exchange rates and payment-provider calculations may cause the final charged amount to differ from a displayed converted amount.
Unless otherwise stated in writing:
- Online prices apply only to eligible online orders.
- Bulk and customized pricing is quoted separately.
- Product prices do not include customs duties, import taxes, brokerage fees, customs-clearance charges, remote-area charges or other destination-related expenses.
- Shipping charges are added at checkout or quoted separately.
- Sample development, molds, tooling, artwork setup, special components, testing and custom packaging may involve separate charges.
If a pricing, product or calculation error is identified before acceptance or dispatch, ENLUME may correct the error and contact the buyer to confirm whether the order should continue under the corrected terms.
Payment
Online orders must be paid using the payment methods made available at checkout.
Bulk, OEM/ODM, private label and customized orders are subject to the payment schedule stated in the applicable quotation, pro forma invoice, sales contract or written order confirmation.
ENLUME is not required to reserve inventory, purchase materials, begin sampling, commence production or dispatch products until the required payment has been received and verified.
Bank charges, payment-provider fees, exchange costs and intermediary fees are borne by the party specified in the applicable payment instructions or written agreement.
Payments must be made only to payment accounts or methods officially confirmed by ENLUME. Buyers should verify unexpected changes to payment instructions through an independent official communication channel before transferring funds.
Inventory and Product Availability
Website inventory may not represent immediate warehouse availability. All online orders are subject to final warehouse availability confirmation.
Products may become unavailable because of prior sales, stock discrepancies, quality inspection, component shortages, discontinued materials or other operational conditions.
If an ordered product is temporarily unavailable, ENLUME may propose:
- An estimated restocking or production lead time.
- A suitable alternative product or color.
- A revised quantity.
- A partial shipment.
- A refund for the affected unavailable product.
Samples and Product Approval
Ready-stock sample orders are intended for evaluation of available products and are different from newly developed custom prototypes.
Customized projects may require sample development before bulk production. Bulk production will not normally begin until the buyer has approved the relevant sample, specifications, color, finish, logo position, packaging solution and other agreed requirements in writing.
Approval may be provided by email, messaging record, signed document, approved sample, confirmed specification sheet or another written method accepted by ENLUME.
Once approval has been provided, later changes may require additional costs, revised minimum quantities, new samples and an updated production schedule.
OEM/ODM and Customized Projects
Buyers should provide sufficient project information, which may include:
- Reference images, drawings or technical files.
- Dimensions and product structure.
- Target materials, stones, components and finishes.
- Plating color and surface requirements.
- Logo method, size and position.
- Packaging and labeling requirements.
- Estimated quantity and target market.
- Destination and expected delivery schedule.
ENLUME may recommend technical adjustments where a requested design, material, component, finish or construction is not suitable for production, quality, cost or compliance reasons.
Production feasibility, final specifications, tolerances, pricing, tooling, samples, minimum quantities and schedules must be confirmed in writing before production.
Customer-Supplied Designs and Materials
When you provide a logo, artwork, drawing, product design, trademark, packaging design, photograph, text, specification or other material, you confirm that:
- You own the material or have sufficient authorization to use it.
- ENLUME may use it as reasonably necessary to review, sample, manufacture, package and fulfill your project.
- Its use for the requested project does not knowingly infringe third-party intellectual property, privacy or other legal rights.
ENLUME may suspend or refuse a project where ownership, authorization, legality or infringement risk is unclear.
The buyer is responsible for claims, losses or costs arising from unauthorized or unlawful materials supplied by the buyer, except to the extent caused by ENLUME’s own unauthorized modification or use.
Intellectual Property
The ENLUME name, website content, product photographs, text, graphics, layouts, branding and other materials created or owned by ENLUME remain the intellectual property of ENLUME or the applicable rights holder.
Website content may not be copied, reproduced, modified, distributed, commercially exploited or used to misrepresent a business relationship without prior written permission.
Ownership and permitted use of custom designs, molds, tooling, technical files, samples and project-specific developments will be determined by the applicable quotation, tooling arrangement, written agreement and payment terms.
Payment of a product or tooling charge does not automatically transfer all intellectual property rights unless a written transfer has been expressly agreed.
Order Changes and Cancellations
Ready-stock orders
A cancellation or amendment request for a ready-stock order must be submitted as soon as possible. Approval is not guaranteed after payment verification, stock allocation, inspection, packing or shipment processing has begun.
Customized and bulk orders
Customized, OEM/ODM, private label and bulk orders cannot normally be cancelled or changed after materials have been purchased, samples approved, tooling started, packaging produced or production commenced.
If ENLUME accepts a cancellation or change, the buyer may be responsible for:
- Completed work and produced goods.
- Purchased or committed materials and components.
- Sample, mold, tooling and artwork costs.
- Custom packaging and labeling costs.
- Administrative, storage, handling and other reasonable project costs.
Deposits and project payments may be non-refundable to the extent they have been applied to approved work, committed materials or costs already incurred.
Production and Lead Times
Sample, production, processing and dispatch schedules are estimates unless ENLUME has expressly accepted a guaranteed date in writing.
Schedules may depend on:
- Final specifications and sample approval.
- Receipt of required payment.
- Availability of materials, components and packaging.
- Order quantity and production complexity.
- Quality inspection and corrective work.
- Buyer response and approval times.
- Shipping capacity, customs procedures and events beyond reasonable control.
A delay caused by missing information, late approval, specification changes or late payment may result in a revised schedule.
Shipping and Delivery
Shipping arrangements are governed by the applicable quotation, order confirmation and our Shipping Policy.
For eligible online orders with a total shipment weight of up to 5 kg, shipping may be calculated at checkout according to the destination and chargeable weight.
Orders above 5 kg and bulk, OEM/ODM, logo, custom packaging and private label orders require a custom shipping quotation unless otherwise agreed.
Delivery and transit times are estimates and do not include warehouse confirmation, order processing, production, quality inspection, packing, customs clearance or delays caused by carriers and destination authorities.
The applicable delivery terms, transfer of risk, transfer of title and responsibility for freight, insurance, customs and import formalities will be determined by the written order documents, agreed shipping terms, any agreed Incoterms rule and applicable law.
Unless otherwise agreed in writing, ownership of products remains with ENLUME until all amounts due for the relevant order have been paid in full.
Customs, Duties and Import Requirements
Unless expressly included in a written quotation or agreement, product prices and shipping charges do not include import duties, customs taxes, brokerage fees, customs-clearance fees or other destination-related charges.
The buyer is responsible for:
- Providing accurate delivery and import information.
- Understanding destination-country import requirements.
- Paying applicable duties, taxes and customs charges.
- Providing permits, registrations or importer documentation when required.
- Ensuring that products may lawfully be imported, marketed, labeled and resold in the intended destination.
Each party remains responsible for the legal and regulatory obligations applicable to its own role.
Inspection, Returns and Claims
Buyers should inspect products, quantities, packaging and shipping condition promptly after delivery.
Claims, returns and remedies are governed by our Returns & Claims Policy, the relevant order documents, approved samples and applicable law.
Visible shipping damage, shortages, incorrect products or other issues that can reasonably be identified during inspection must be reported within 7 calendar days after delivery.
Submitting a claim does not automatically confirm acceptance of the claim. ENLUME may review the order records, photographs, videos, packaging, shipping information, approved samples and confirmed specifications before proposing a solution.
Products must not be returned without prior written authorization. Unauthorized returns may be refused or returned to the sender at the sender’s cost.
Items Not Normally Eligible for Return
Unless otherwise agreed in writing or required by applicable law, returns are not normally accepted for:
- Change of mind, slow sales or market response.
- Incorrect buyer selection or ordering errors.
- Products that have been worn, used, altered, repaired, repackaged or resold.
- Damage caused by improper handling, storage, moisture, chemicals, perfume, cosmetics, friction, impact or heat.
- Normal wear or gradual changes to plated and surface finishes.
- Unauthorized returns.
- Customized, logo, private label or custom packaging products that match the approved sample and confirmed specifications.
Product Care and Use
The buyer is responsible for communicating appropriate product care, storage and use information to its customers where applicable.
Jewelry should generally be protected from moisture, chemicals, perfume, cosmetics, excessive friction, impact, heat and unsuitable storage conditions.
Plated finishes, pearls, stones, enamel, resin and handmade elements may change over time depending on use, environment, care and storage. Normal wear and gradual finish changes are not automatically manufacturing defects.
Compliance and Destination-Market Requirements
Product testing, certification, labeling, documentation and destination-market compliance services are included only when expressly confirmed in writing.
The buyer must inform ENLUME before production of any mandatory technical, material, chemical, testing, labeling, packaging or documentation requirement for the intended market.
ENLUME is not responsible for requirements that were not disclosed before quotation, sampling or production, except for obligations that apply directly to ENLUME and cannot lawfully be excluded.
Any compliance statement, test report or certification applies only to the specific product, material, batch, test scope and conditions identified in the relevant document.
Third-Party Services
The website and order process may use third-party payment providers, logistics providers, carriers, software services, analytics tools and communication services.
Third-party services may be subject to their own terms, privacy policies, availability and operating rules. ENLUME is not responsible for a third party’s independent acts, omissions, system outages or service changes, except to the extent ENLUME is legally responsible.
Disclaimer of Additional Warranties
Products and services will be supplied according to the confirmed order documents, approved samples, written specifications and any express written warranty provided by ENLUME.
To the maximum extent permitted by applicable law, no additional representation, guarantee or warranty applies unless expressly stated in writing.
Nothing in these Terms & Conditions excludes any warranty, condition, duty or liability that cannot lawfully be excluded.
Limitation of Liability
To the maximum extent permitted by applicable law, ENLUME will not be liable for indirect, incidental, special, punitive or consequential losses, including loss of profit, revenue, business, goodwill, anticipated savings, market opportunity or customer relationships.
Where liability may lawfully be limited, ENLUME’s total aggregate liability arising from a particular order or project will not exceed the amount actually paid to ENLUME for the affected products or services giving rise to the claim.
ENLUME is not responsible for loss or damage resulting from:
- Incorrect or incomplete information supplied by the buyer.
- Unauthorized use, alteration, repair, repackaging or resale.
- Improper storage, handling, care or use.
- Buyer-supplied designs, logos, specifications or instructions.
- Import restrictions or destination requirements not disclosed before the order.
- Carrier, customs or third-party delays outside ENLUME’s reasonable control.
Nothing in these Terms & Conditions excludes or limits liability for fraud, fraudulent misrepresentation, wilful misconduct, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited.
Force Majeure
ENLUME will not be responsible for delay or failure caused by events beyond its reasonable control, including natural disasters, severe weather, fire, flood, epidemic, pandemic, war, civil disturbance, government action, sanctions, trade restrictions, labor disputes, power failure, material shortage, transportation disruption, customs delay, carrier interruption or telecommunications failure.
Where such an event occurs, ENLUME may extend the schedule, suspend affected obligations, propose an alternative solution or cancel the affected part of the order. The parties will discuss any completed work, committed materials, available products and reasonable costs already incurred.
Electronic Communications and Records
You agree that quotations, invoices, order confirmations, approvals, notices and other communications may be provided electronically, including through email, the website and agreed business messaging channels.
Electronic records, messages, approvals and payment records may be used to document the transaction, subject to applicable law.
You are responsible for keeping your contact information current and for reviewing communications sent to the contact details provided.
Privacy
Personal and business contact information is handled according to our Privacy Policy and applicable data-protection requirements.
You must provide personal information about another person only where you have appropriate authority or another lawful basis to do so.
Suspension or Refusal of Service
ENLUME may suspend, reject or cancel an inquiry, quotation, account, project or order where reasonably necessary because of:
- Suspected fraud, unlawful activity or payment risk.
- Abusive, threatening or misleading conduct.
- Intellectual-property or compliance concerns.
- Repeated failure to provide required information, approval or payment.
- Technical or production infeasibility.
- Sanctions, trade restrictions or legal requirements.
Where payment has already been received, any refund or deduction will be determined according to the accepted work, committed materials, applicable policies, payment-provider rules and applicable law.
Governing Law and Disputes
Unless otherwise agreed in writing or required by mandatory applicable law, these Terms & Conditions and transactions with ENLUME are governed by the laws of the Hong Kong Special Administrative Region.
The parties should first attempt to resolve any dispute through good-faith business communication.
If a dispute cannot be resolved through negotiation, it will be submitted to the courts of the Hong Kong Special Administrative Region, unless the parties have agreed in writing to another dispute-resolution method or jurisdiction.
General Provisions
If any provision of these Terms & Conditions is held to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
A failure or delay by ENLUME to enforce a provision does not constitute a waiver of that provision or any other right.
The buyer may not transfer an accepted custom project or contractual obligation to another party without ENLUME’s written consent. ENLUME may use affiliated companies, manufacturers, service providers and subcontractors to perform parts of an order while remaining responsible for obligations applicable to ENLUME.
If these Terms & Conditions conflict with a signed contract, accepted quotation, pro forma invoice, written order confirmation or specifically agreed project terms, the more specific written document will prevail for that transaction.
Changes to These Terms
ENLUME may update these Terms & Conditions to reflect changes to the website, services, business processes or legal requirements.
The version published when an order is accepted will generally apply to that order unless the parties agree otherwise in writing or a change is required by applicable law.
